In the late seventies of the 20th century, Jacob Taubes, a philosopher of religion and a scholar in Jewish thought, visited Carl Schmitt in his home. Schmitt was a scholar in constitutional and international law who joined the Hitler regime in 1933. Both were fascinated by the apocalyptic tradition, albeit it in opposite ways. They had a conversation about the apostle Paul, especially about his ‘Letter to the Romans’. Their discussion focused on the passage in which Paul speaks of the (...) Jews as 'enemies of God'. Against the background of history’s violent anti-Semitism, this exceptional conversation deconstructs Paul’s texts, traditionally conceived as constitutive of orthodox Christianity, and opens them up for a more subversive, heterodox reading. By Taubes, Paul is portrayed as an heretic Jew who joined the ‘Jesus movement’. He remained loyal to his tradition, while at the same time searching for new forms of spiritual community, avoiding direct political actions, as well as Gnostic interiorization, and establishing a new Law. Various claims have been made, recently, that Darwin's argumentation in the Origin instantiates and so supports some general philosophical proposal about scientific theorizing, for example, the "semantic view". But these claims are grounded in various incorrect analyses of that argumentation. A summary is given here of an analysis defended at greater length in several papers by the present author. The historical and philosophical advantages of this analysis are explained briefly. Darwin's argument comprises three distinct evidential cases on behalf of natural (...) selection, cases, that is, for its existence, its adequacy and its responsibility. Einstein’s razor, a corollary of Ockham’s razor, is often paraphrased as follows: make everything as simple as possible, but not simpler. This rule of thumb describes the challenge that designers of a legal system face—to craft simple laws that produce desired ends, but not to pursue simplicity so far as to undermine those ends. Complexity, simplicity’s inverse, taxes cognition and increases the likelihood of suboptimal decisions. In addition, unnecessary legal complexity can drive a misallocation of human capital toward comprehending and (...) complying with legal rules and away from other productive ends. While many scholars have offered descriptive accounts or theoretical models of legal complexity, most empirical research to date has been limited to simple measures of size, such as the number of pages in a bill. No extant research rigorously applies a meaningful model to real data. As a consequence, we have no reliable means to determine whether a new bill, regulation, order, or precedent substantially effects legal complexity. In this paper, we begin to address this need by developing a proposed empirical framework for measuring relative legal complexity. This framework is based on “knowledge acquisition”, an approach at the intersection of psychology and computer science, which can take into account the structure, language, and interdependence of law. We then demonstrate the descriptive value of this framework by applying it to the U.S. Code’s Titles, scoring and ranking them by their relative complexity. We measure various features of a title including its structural size, the net flow of its intra-title citations and its linguistic entropy. Our framework is flexible, intuitive, and transparent, and we offer this approach as a first step in developing a practical methodology for assessing legal complexity. (shrink)

International business organizations are regularly addressed on their corporate social responsibility (CSR). As illustrated in this paper, it is not yet clear exactly what CSR means to organizations and how to deal with it. In this paper, the authors explore how a sensemaking approach helps to understand the business challenges of CSR within an organizational context. The theories of Karl Weick are applied to the experiences of CSR in Royal Dutch Shell. The authors argue that the key to CSR in (...) international business organizations is to engage stakeholders and start a process of joint sensemaking. Three main competencies are crucial in this: the competency to engage stakeholders through listening and understanding; the creation of an organizational language so that CSR makes sense to members of the organization; and recognizing the momentum of taking action. I distinguish between sentences like(1) Last Thursday we drove from Wellington to Waikanae and (2) Last Thursday my copy of Aspects of the Theory of Syntax remained on my bookshelf. Sentence (2) has the subinterval property. If it is true at an interval t it is true at every subinterval of t. (1) lacks this property. (1) reports an event. (2) reports a state. Events do not have the subinterval property but states do have it, and so do objects. If (...) something is a linguist at an interval t then that person is a linguist at all subintervals of t. I argue that exists applies to things which have the subdinterval property, and occurs applies to things which lack it. (shrink)

The theory of mental models and its computer implementations have led to crucial experiments showing that no standard logic—the sentential calculus and all logics that include it—can underlie human reasoning. The theory replaces the logical concept of validity (the conclusion is true in all cases in which the premises are true) with necessity (conclusions describe no more than possibilities to which the premises refer). Many inferences are both necessary and valid. But experiments show that individuals make necessary inferences that are (...) invalid, e.g., Few people ate steak or sole; therefore, few people ate steak. Other crucial experiments show that individuals reject inferences that are not necessary but valid, e.g., He had the anesthetic or felt pain, but not both; therefore, he had the anesthetic or felt pain, or both. Nothing in logic can justify the rejection of a valid inference: a denial of its conclusion is inconsistent with its premises, and inconsistencies yield valid inferences of any conclusions whatsoever including the one denied. So inconsistencies are catastrophic in logic. In contrast, the model theory treats all inferences as defeasible (nonmonotonic), and inconsistencies have the null model, which yields only the null model in conjunction with any other premises. So inconsistences are local. Which allows truth values in natural languages to be much richer than those that occur in the semantics of standard logics; and individuals verify assertions on the basis of both facts and possibilities that did not occur. We consider the desirability, or otherwise, of various forms of induction in the light of certain principles and inductive methods within predicate uncertain reasoning. Our general conclusion is that there remain conflicts within the area whose resolution will require a deeper understanding of the fundamental relationship between individuals and properties.

A (normal) system of propositional modal logic is said to be complete iff it is characterized by a class of (Kripke) frames. When we move to modal predicate logic the question of completeness can again be raised. It is not hard to prove that if a predicate modal logic is complete then it is characterized by the class of all frames for the propositional logic on which it is based. Nor is it hard to prove that if a propositional modal (...) logic is incomplete then so is the predicate logic based on it. But the interesting question is whether a complete propositional modal logic can have an incomplete extension. In 1967 Kripke announced the incompleteness of a predicate extension of S4. The purpose of the present article is to present several such systems. In the first group it is the systems with the Barcan Formula which are incomplete, while those without are complete. In the second group it is those without the Barcan formula which are incomplete, while those with the Barcan Formula are complete. But all these are based on propositional systems which are characterized by frames satisfying in each case a single first-order sentence. (shrink)

The aim of this paper is to consider some logical aspects of the debate between the view that the present is the only 'real' time, and the view that the present is not in any way metaphysically privileged. In particular I shall set out a language of first-order predicate tense logic with a now predicate, and a first order (extensional) language with an abstraction operator, in such a way that each language can be shewn to be exactly translatable into the (...) other. I shew that this translation is preserved at the metalinguistic level, so that equivalent truth conditions can be defined in a tensed metalanguage or an indexical metalanguage. I then make some remarks about the connection between proofs of relative consistency and metaphysical truth; and some historical remarks about Arthur Prior's use of formal logic in expressing his presentist views. This paper explores a modal analogue of Hugh Mellor''s version of McTaggart''s argument against the reality of tense. I show that if Mellor''s argument succeeds in showing that the present moment cannot be any more real than any other moment then it also shows that the actual world cannot be any more real than any other possible world.

In Physics Book 2, Aristotle defines nature as an internal source of change. By elaborating Aristotle's view of change, Book 3 takes an important step in establishing the claim - to be made in Book 8 - for a divine mover who causes change but in whom no change occurs. Book 3 also introduces Aristotle's doctrine of infinity as always potential, but never actual and never traversed.
